Safety Policy

This Safety Policy is published by Banyan Way, Inc. ("Hum," "us," or "we"), operator of the Hum mobile application and related services (the "Services"). It is adopted in compliance with the Colorado Online Dating Services Safety Act, CRS §6-1-731.5, and applies to all members of the Services, not only Colorado members.

1. Prohibited Conduct

The following conduct violates Hum's policies and may result in immediate account suspension or termination, reporting to law enforcement, and other legal action:

2. Reporting Misconduct

Hum provides the following mechanisms for members to report policy violations and safety concerns:

Hum will acknowledge safety reports and investigate reported violations. Where a violation is substantiated, Hum may take action up to and including permanent account removal, and will cooperate with law enforcement investigations as required by law.

3. Criminal Background Checks

HUM DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS. Hum offers a face verification feature that uses Amazon Rekognition to confirm that a member's profile photos reasonably match the person using the account. Face verification is not a criminal background check, does not verify identity, and does not screen for criminal convictions, sex offender status, or restraining orders. Members should not rely on face verification or any "verified" badge as a guarantee of another member's safety, identity, or background.

4. How Hum Responds to Misconduct Reports

When Hum receives a report of misconduct, our trust and safety team will:

Hum does not tolerate retaliation against any member for making a good-faith safety report.
